Case Study

Helping an organisation move forward through independent investigation

The Challenge

A large not-for-profit organisation faced a complex and highly sensitive situation involving multiple whistleblowing disclosures, employee grievances and concerns relating to culture, leadership, governance, workplace relationships and decision-making. The issues raised covered a wide spectrum, including allegations of bullying, discrimination, health and safety concerns, governance processes, recruitment practices and organisational culture. The issues involved senior leaders and generated significant concern for those directly affected.
As often happens in cases of this nature, opinions had become polarised. Individuals held strongly differing accounts of events, trust had deteriorated, and uncertainty about what had happened was beginning to affect organisational effectiveness as well as individual wellbeing. Several employees reported significant stress arising from the situation and the matters under investigation.

Our Approach

Campbell Tickell was commissioned to conduct an independent investigation into the whistleblowing disclosures and employee grievances. The investigation examined a substantial volume of evidence, including:

01

Multiple whistleblowing disclosures.

02

Several employee grievances.

03

Interviews with staff and senior leaders.

04

Documentary evidence and correspondence.

05

Policy, governance and HR records.

The investigation was designed to be independent, evidence-led and fair. Particular care was taken to distinguish between concerns that could be substantiated by evidence, concerns that were not supported by evidence, and issues where wider organisational lessons could be learned regardless of the outcome of individual allegations

What We Found

The investigation revealed a more nuanced picture than many participants had expected.

Some concerns were not substantiated when tested against the available evidence. Others highlighted governance weaknesses, process failures, inconsistent management practice, poor communication or shortcomings in organisational decision-making. In several instances, what initially appeared to be individual complaints pointed towards broader questions about organisational culture, oversight, accountability and leadership behaviours.

Importantly, the independent review provided a structured means of separating fact from perception, identifying where evidence supported concerns and where it did not. It also enabled the organisation to move beyond anecdote, assumption and workplace speculation.

The Outcome

The work was not easy for anyone involved.

Those raising concerns were required to put forward evidence and relive difficult experiences. Individuals whose actions were questioned faced scrutiny of significant decisions and behaviours. Leaders, managers and board members were required to confront uncomfortable questions about culture, governance and oversight.

However, the investigation achieved something extremely important: it created a trusted, independent evidence base on which decisions could be made.
Rather than continuing cycles of allegation and counter-allegation, the organisation was able to rely on an impartial assessment of events and a clear set of findings, recommendations and lessons. The process provided stakeholders with confidence that concerns had been taken seriously, examined thoroughly and considered fairly.

Impact

The investigation enabled the organisation to:

01

Address complex whistleblowing and grievance matters through an independent process.

02

Distinguish substantiated concerns from unsubstantiated allegations.

03

Identify governance, leadership and cultural improvements.

04

Strengthen confidence in organisational decision-making.

05

Reduce uncertainty and speculation by establishing a clear evidence base.

05

Create the conditions necessary to rebuild trust and working relationships.

05

Move from conflict towards organisational recovery and improvement.

Key Lesson

Not every investigation ends with dramatic findings or disciplinary action. Sometimes the greatest value lies in providing clarity.

In this case, the investigation demonstrated the importance of independence, thoroughness and procedural fairness when organisations face difficult internal challenges. While the process was demanding for those involved, the resulting evidence-based conclusions enabled the organisation to draw a line under a prolonged and complex situation, learn lessons from it and focus on the future with greater certainty and confidence.

Independent investigations can be challenging for everyone involved. But when conducted rigorously and fairly, they provide organisations with something invaluable: a credible foundation for decision-making, learning and moving forward.
